Terms of Service

1. Acceptance

By installing SMS & Drip for Twilio ("the Service", "we", "us"), you agree to these terms. If you are accepting these terms on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. User Responsibilities

• Compliance: You agree to comply with all SMS regulations (TCPA, GDPR).
• Consent: You are solely responsible for obtaining consent from message recipients.
• No Spam: We reserve the right to terminate service for spam activity.

3. Fees

• App Subscription: Billed via monday.com Marketplace.
• Twilio Charges: You are responsible for all SMS fees and carrier surcharges charged by Twilio. We are not liable for these costs.

4. Privacy & Data

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the data practices outlined therein.

5. Termination & Suspension

We may suspend or terminate your access to the Service immediately and without notice if we have reason to believe you are violating these Terms, including generating spam, complaints, or violating carrier regulations (e.g., A2P 10DLC).

6. Limitation of Liability & Indemnification

The service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding uptime, message deliverability, or carrier compliance.

Indemnification: You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, particularly any claims related to TCPA violations, non-consensual messaging, or violation of Twilio's Acceptable Use Policy.

7. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted to this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.
